1.- MEMBERSHIP TO THE CLUB
To become a Member of the Halifax Club offered by HSYG to clients of “Banco Halifax Hispania, S.A., Sociedad Unipersonal” (hereinafter “Halifax”) it suffices to open an Xtra Account.
The information with the data of new Members of the club is forwarded on a weekly basis by HSYG to Zurich, which is in charge of the operation of the Helpline Service and other services. Therefore, a week can lapse since the opening of the account by the client of Halifax until the Helpline Service operated by Zurich or other services or discounts can be effectively used.
The Member declares to be 18 year old or to be legally emancipated.
2.- IDENTIFICATION OF THE MEMBER
The Member is identified through his/her name and passport number, ID Card, NIE (Foreigner Identification Card) or any other similar identification document. These data will be included in the HSYG databases created with the registrations with Halifax Club, and transferred to Zurich for the sole purposes of this contract.
The Member agrees to make an adequate and diligent use of the services rendered, including those that can be accessed through the Helpline Service, and the Member will be the only party responsible for an unlawful use or a use against these General Terms and Conditions and the Special Conditions applicable on a case-by-case basis.
3.- OBJECTIVE AND OPERATION OF THE SERVICE
The services currently made available by the Halifax Club to its Members, by virtue of the agreement reached with Zurich, are the following:
a) An accident insurance, free of charge for the Member, directly underwritten with Zurich, in accordance with the specific terms and conditions set out by this Company.
b) Through the Helpline Service operated by Zurich, the mediation to provide, in English, the contracting of the following services:

This list can be amended at any time by HSYG, in accordance with the provisions of Clause 9. Especially, it will be modified in the case that the agreement reached by Halifax and HSYG with Zurich is altered and in the case that this latter modifies the services rendered by virtue of such agreement. A more detailed description of the specific services rendered can be found in the information brochure.
Halifax Club, Halifax and HSYG only act as intermediary to facilitate the access of the Members to these services - which merely consists of co-operating with the contracting - through a Helpline Service operated by Zurich which answers calls in English. Lloyds Banking Group entities do not assume any responsibility for the non fulfilment, for an inadequate fulfilment or for the way in which such services are rendered and their consequences.
Lloyds Banking Group will not be responsible for the execution of the eventual service agreement between third parties and the client, and the client considers that the service has been fully and satisfactorily rendered since the moment on which the English-speaking operator puts the Member in contact with the relevant professional or provides sufficient information on how to contract the desired services.
There is no obligation to contract a minimum annual service for the fact of being a Member of Halifax Club.
The Halifax Club service is rendered within the Spanish Peninsula, the Balearic and the Canary Islands.
4.- FEES
Membership to the Halifax Club is free of charge for all the holders of a Halifax Xtra Account.
The cost to be paid by the client for the use of the service will only consist of the telephone rates in force from time to time for numbers subject to an additional 902 rate, at any place of the Spanish territory.
The cost of the services contracted through the means and facilities provided by Zurich through the Halifax Club will be directly paid by the Member, who can order a direct debit into the Xtra Account opened in his/her name with Halifax, either as first holder or a holder duly empowered.
5.- INCIDENCES
In the case of incidences in the delivery of the goods or in the rendering of the services contracted with third parties through the Helpline Service of Zurich as a result of the membership to the Halifax Club, or in the case that the Member wishes to return, repair, make good, etc. a product purchased from a third party through the Halifax Club or make a claim for any service, the Member must address such claim directly to the vendor or the renderer of the service.
In the case that the answer from the vendor or the renderer of the service is not satisfactory, the Member can contact the Customer Relations Service by e-mail at halifaxclub@halifax.es, or by calling 91 782 03 00 (office hours), it being necessary that the Member evidences the claim forwarded in writing to the vendor or renderer of the service as well as the relevant answer received.
The Member acknowledges that both Halifax Club and the Lloyds Banking Group entities do not assume in any case the function of a producer, vendor, importer or marketer of any good and do neither grant any commercial guarantee in connection with the goods or services contracted.
Members are requested to inform themselves about the method and conditions for the payment of the services before contracting any product or service through the Helpline Service operated by Zurich.
6.- DATA PROTECTION
Personal data of the Members of the Halifax Club, as well as the data related to the contracting of any services through it, will be kept in a personal data file owned by HSYG, which guarantees the full compliance with the legislation on the Protection of Personal Data and, in accordance with Basic Law 15/1999, the Member is informed and accepts the inclusion of his/her data in a computer file registered with the RGPD, and the computer processing of such data for the purpose of forwarding commercial information, in order to tailor our commercial offers to his/her specific profile and to comply, if appropriate, with the legal and contractual liabilities assumed towards such clients. You accept that your personal data are transferred, for the same purposes, to other companies of the Lloyds Banking Group. In order to render a more efficient service to Members, Halifax can provide information on the status of your account and on other personal data provided by you, on a confidential basis, to other entities of the Lloyds Banking Group.
Similarly, such personal data will be transferred to Zurich España Compañía de Seguros y Reaseguros, S.A. and to companies of its Group to facilitate the rendering of the services contracted and to offer information, specifically addressed to you or not, about the services of the Company or its Co-operating Companies.
The commercial information of HSYG and the companies of the Lloyds Banking Group as well as the information on the services contracted can also be forwarded through electronic means. The consent granted to HSYG and the companies of the Lloyds Banking Group related to the use of commercial information through electronic means can be revoked at any time by sending an e-mail to that effect to the following address: halifaxclub@halifax.es
The privacy policy of HSYG guarantees the exercise of the access, rectification, cancellation and objection rights in accordance with the provisions set out by the legislation in force, before the Controller of the File, at the following address: HSYG, Paseo de la Castellana no. 86, 5th floor, Madrid.
7.- NOTICES ABOUT CHANGES
HSYG reserves the right to introduce changes in the general terms and conditions related to the access, operation and rendering of the services of the Halifax Club, without a prior notice. However, the Member will be informed about such changes as soon as possible. HSYG waives any liability in connection with the alterations that might occur until the notice is forwarded to the Member.
8.- RIGHT OF ADMISSION AND TERMINATION
HSYG reserves the right of admission to the Halifax Club and of rendering of the service.
Without prejudice to the above, this contract is subject to the following reasons for termination, which will be exercised by HSYG at its discretion: if the Member is no longer a client of Halifax, if Halifax discontinues the Xtra Account and its services, if the contractual relationship between Halifax, HSYG and Zurich is terminated for any reason, or if the Xtra Account or any other current account of the Member with Halifax is overdrawn or insolvent.
9.- EXCLUSION OF GUARANTEES AND LIABILITY
The eventual relationships between the Members and Zurich or other third parties that render the services, either of a commercial or any other nature, accessed through the Helpline Service operated by Zurich to which the Halifax Club facilitates such access, are the exclusive responsibility of the Members and the renderers of the services and neither HSYG nor other companies of the Lloyds Banking Group will be liable before them for their respective actions or omissions. The Members and the renderers of the services will act in any case in their own name and for their own account both in connection with the offer and the contracting of products or services, which falls under their own and exclusive responsibility, irrespective of the way in which the Members have accessed such services.
Consequently, the companies of the Lloyds Banking Group do not grant any guarantee and are not responsible in any case for any damages of any kind derived from:
· The delay in registering the Client as a Member of the Halifax Club.
· The lack of availability, maintenance or effective operation of the Helpline Service operated by Zurich, of the Halifax Club and/or its services.
· The lack of punctuality, usefulness, adequacy or validity of the services rendered by third parties to meet the needs, activities, specific results or expectations of the Members.
· The unlawful, negligent, fraudulent use or a use of the services, on the part of the Members, that goes against these General Terms and Conditions, the principles of good faith, the generally accepted practices or the public order.
· The lack of quality, reliability, usefulness and availability of the services rendered by third parties and made available to the users through the Helpline Service of Zurich, the use of which is offered to the Members of the Halifax Club.
· The non fulfilment, by third parties, of their liabilities or commitments in connection with the services rendered to the Members as a consequence of the use of the telephone number of the Helpline Service of Zurich, the use of which is offered to the Members of the Halifax Club, and vice versa, the non fulfilment, on the part of the Members, of their liabilities towards the renderers of the services.
10.- LEGISLATION AND JURISDICTION
This contract will be governed by the legislation of the Kingdom of Spain. The parties submit any dispute, controversy or claim that might arise in connection with the fulfilment, validity or constructions of this contract, to the jurisdiction of the Courts of Madrid (city).
11.- DEFINITIONS
a) “HSYG” means Halifax Servicios y Gestiones, S.L., a company of the Halifax Bank of Scotland (Lloyds Banking Group) Group.
b) Banco Halifax Hispania, Sociedad Anónima Unipersonal, will also be called “Halifax".
c) “The Member" means any individual who holds a Halifax Xtra Account, who has adhered to these general terms and conditions and has become a Member of the Halifax Club.
d) “The Services” means the provision to the Member of a series of advantages and discounts, among them an attention-to-customer telephone number to access, through an English-speaking operator, a series of services and useful information listed in Clause 3.
e) “Zurich” means Zurich España Compañía de Seguros y Reaseguros, S.A.
f) “Helpline Service” means the physical place where the operators, in English, help to contract certain services in Spain. The specific operation of the rendering of the “Helpline Service” is the sole responsibility of Zurich, an insurance company that renders such service by virtue of an agreement with HSYG and Halifax.
g) RGPD, means the General Data Protection Register, a body of the Spanish Data Protection Agency which is in charge of watching over the publicity of the existence of files and the processing of data of a personal nature.
12.- RENDERER OF THE SERVICE
The company in charge of rendering the services and special discounts made available to the Members of the Halifax Club, among them to act as intermediary for the contracting of other services of a general nature listed in Clause 6, as a result of the agreement reached with Zurich, is Halifax Servicios y Gestiones, S.L. (hereinafter, “HSYG”), a Spanish company domiciled in Paseo de la Castellana no. 86, 5th floor, Madrid, holder of V.A.T. no. B-81819492.
